According to the report, Best-in-Class companies save an average of 38 percent in legal discovery costs over the course of a lawsuit. The benefits extend further, with 91 percent of those companies reporting that they avoided paying fines or losing legal proceedings as a result of their e-Discovery processes.

“Company litigation risks for email have increased dramatically as a result of new government regulations such as the December 2006 Federal Rules of Civil Procedure (FRCP) amendment,” said Ralph A. Rodriguez, Senior Vice President of Technology Research, Aberdeen Group. “We are advising businesses to review their data, message and record recovery service level agreements to ensure they can access data in a reasonable timeframe. Despite the clear benefits involved with having a solid process for e-discovery, the study also noted that more than half (59 %) of respondents have no e-discovery strategy in place. This finding illustrates the lack of priority e-discovery is taking in the majority of organizations.

“FRCP regulations and increased e-discovery costs are driving this issue further up the list of priorities; however, for many companies, it can still be difficult to justify the cost of an archive that may only be used once or twice a year for legal reasons,” said Eric Goodwin, CEO, Fortiva. “The result is that many companies find substandard solutions or they do nothing at all.
