Boston Attorney David Governo Wins 3-Week Asbestos Trial

Governo Law Firm Secures Defense Verdict for Client in Personal Injury Claim Brought by Massachusetts Plaintiff

Boston, MA (Lexis Nexis/PRWEB ) May 19, 2008 -- United Gilsonite Laboratories (UGL), a Scranton, Penn.-based manufacturer of home maintenance products, received a defense verdict last month in an asbestos personal injury claim brought by a terminally ill man in Massachusetts.

The company was represented in Donlan v. Certainteed Corp. and United Gilsonite Laboratories (Docket # 07-0774) by David Governo, managing partner of the Boston-based Governo Law Firm. The case was resolved in a jury trial at the Brockton Superior Court.

The plaintiff in the case was a 58 year-old man and former electrical contractor who is suffering from mesothelioma, a form of cancer that develops in the mesothelium, a protective lining that covers most of the body's organs. In its defense verdict, the jury found against the plaintiff in his claims that UGL was responsible for his illness.

"Our trial strategy was to tell a story to the jurors that would allow them to put the plaintiff's alleged exposure to asbestos into a proper context," explained Mr. Governo. "We had a leading expert in industrial hygiene who testified that the plaintiff's job made it highly unlikely for him to have experienced significant exposure, and a top-notch medical expert who testified that it was impossible that asbestos from UGL's product was the actual cause of his illness. Armed with these clear and persuasive facts, the jurors were able to make a well-reasoned decision that UGL was not responsible for the plaintiff's mesothelioma."

According to Governo, his firm has successfully defended clients in many asbestos claims, and this is the second time he has obtained a rare defense verdict in a "living mesothelioma" case.
